GloBeam respects the intellectual property rights of others and expects users of the GloBeam platform, applications, websites, and services (collectively, the "Services") to do the same. This DMCA Policy describes GloBeam's procedures for responding to copyright infringement claims under the United States Digital Millennium Copyright Act ("DMCA") and other applicable laws.
1. SCOPE OF THIS POLICY
This policy applies to all content uploaded, posted, transmitted, displayed, shared, or otherwise made available through GloBeam, including videos, images, audio, music, live streams, comments, text, event postings, and other user-generated content.
2. COPYRIGHT OWNERSHIP
Users retain ownership of their original content to the extent permitted by applicable law. Users may not upload or distribute content that infringes the copyrights or other intellectual property rights of third parties.
3. REPEAT INFRINGER POLICY
GloBeam maintains a policy for terminating or restricting accounts of users who repeatedly infringe copyrights or repeatedly violate GloBeam's intellectual property policies. GloBeam reserves the right to suspend, restrict, demonetize, mute, remove, or terminate accounts and content at its discretion.
4. SUBMISSION OF DMCA NOTICES
If you believe that content available through GloBeam infringes your copyright, you may submit a copyright complaint to GloBeam's designated DMCA agent. A valid notice should include sufficient information to identify the copyrighted work, the allegedly infringing material, and the complaining party.
5. REQUIRED INFORMATION FOR COPYRIGHT COMPLAINTS
A copyright complaint should generally include:
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the allegedly infringing material and its location on GloBeam;
- Contact information of the complaining party;
- A statement of good-faith belief that the use is unauthorized;
- A statement under penalty of perjury that the information is accurate and that the complaining party is authorized to act on behalf of the copyright owner;
- An electronic or physical signature.
6. COUNTER-NOTIFICATION PROCEDURE
If your content was removed or disabled due to a copyright complaint and you believe the removal was mistaken or improper, you may submit a counter-notification in accordance with applicable law. GloBeam may restore the content in appropriate circumstances if the complaining party does not provide timely notice of legal action.
7. GLOBEAM'S RIGHTS AND DISCRETION
GloBeam reserves the right, but not the obligation, to investigate alleged infringements and to remove, restrict, mute, demonetize, geo-block, limit visibility of, or otherwise take action regarding any content or account at its discretion. GloBeam may act with or without prior notice.
8. INCIDENTAL BACKGROUND AUDIO AND REAL-WORLD RECORDINGS
GloBeam is a reality-oriented platform that may contain real-world recordings involving ambient sounds, public environments, incidental background music, emergency events, community activities, local businesses, travel recordings, and similar real-world content. GloBeam may evaluate copyright complaints involving incidental or background audio on a case-by-case basis consistent with applicable law, platform policies, operational considerations, and public-interest concerns.
9. FALSE OR MISLEADING CLAIMS
Submitting knowingly false, misleading, fraudulent, or abusive copyright complaints or counter-notifications may result in account restrictions, legal liability, termination of access to GloBeam, or other actions.
